A Philadelphia jury has awarded a mother $78.5 million after her son, now age 3, suffered from a birth injury when there was complications during the delivery. The court found that the hospital was negligent in this case because they failed to provide adequate equipment and staff.

According to court documents, the woman went into Pottstown Memorial Medical Center after showing signs that the child was suffering from complications.

Experts concluded that the woman showed signs that the child was deprived of oxygen and a quick delivery would have saved the child from injury, but an original ultrasound done showed that the child no longer had a heartbeat.

Later, a second ultrasound was done and showed that there was faint heartbeat and an emergency cesarean section was done. There was an 81-minute period where the child was deprived of oxygen and this caused the fetus to be born with cerebral palsy.
