While most of your preparation will be done when we meet for a mock cross-examination, there are several important tips to keep in mind when preparing for your deposition:
Talk it over with your attorney
When we are preparing for a deposition, we will discuss the facts of the case, how to compose yourself while being questioned, and I will answer any questions you have regarding the process.
Have all documentation ready
Bring copies of any documents that have been requested.
Be polite
Don’t lose your temper or act dismissive when the opposing counsel is asking you questions. While you may think that their questions are rude, or that the whole situation is unnecessary since you’re entitled to compensation, keeping your composure and being polite will help your case and show you in a more favorable light.
Pay attention
Make sure when the opposing counsel is asking you questions that you pay attention and answer the questions as completely as possible. If you don’t understand the question, be earnest and ask them to explain it to you.
Never lie
It is illegal to lie under oath. Under no circumstances should you ever lie during a deposition.
Don’t guess
If you don’t know the answer to a question asked, just admit to it. It will never benefit you to try to make something up. Making up an answer could also be considered lying under oath, and as stated above, you should never lie during a deposition.
Don’t talk too much
Just provide the answers to the questions asked. Don’t provide extra detail or side notes. Clear and concise answers will serve you best, and if the opposing counsel needs further clarification, then they will ask for it.
