A wrongful death lawsuit against the U.S. Border Patrol has been filed by the family of a slain 32 year-old mother who was shot and killed by a Border Patrol agent in San Diego. The family contests that the agent has an extensive history of misconduct and should not have been on allowed on the streets.
According to local law enforcement, the woman was leaving an apartment on September 28 at the same time border patrol was serving a warrant for someone at the complex. Officials then say she got into her car and purposefully struck a 34 year-old agent. He claims he shot at the mother of five nine times after she refused to stop as he clung to the hood of her car for several hundred yards. The National Border Patrol Council says the agent’s actions were warranted because he feared for his life.
However, family members claim that the agent was in the wrong. According to Fox News, the deceased’s family points to four instances in four years in which the man was suspended for misconduct when he was a sheriff’s deputy for Imperial County. They allege that he was warned about his termination and later willingly left the force.
